What to Do If an Employer Won't Pay You
If you're not being paid what you're owed, there's a practical escalation path worth following in order.
1. Request payment in writing
A written request (email, not just a phone call) creates a record and is often enough to resolve a genuine oversight.
2. For unpaid wages
The Fair Work Ombudsman offers a free service to help resolve underpayment, and can investigate on your behalf.
3. For unpaid invoices as a subcontractor
Most states have a Security of Payment Act process — a fast-track legal mechanism specifically designed for unpaid construction and trades work, generally quicker and cheaper than going through the courts.
4. If it's genuinely unresolved
The Fair Work Commission (for employment matters) or small claims court (for smaller invoice disputes) are the next formal steps.
